Welcome to the Monroe County Probation Services. Proudly serving the citizens of Monroe County and elsewhere, our Probation Department not only strives to assist each probationer in successfully completing their court-ordered sentence, but we also work with law enforcement agencies, community organizations, and other criminal justice partners to ensure and promote public safety. Our goal, as the 16th Judicial Circuit’s Probation staff, is to effectively guide you through your time with Probation. Your supervision begins when you are either sentenced by the Court or you enter into a Diversionary Agreement.

While we do not provide legal advice, our aim is to offer the tools, encouragement, and direction you need to successfully complete your probation or diversionary program.

You Have Been Placed on Probation, now what?

Once you have been sentenced to probation or entered into a diversionary program, you are under the supervision of Probation Services. We will assist you in any way we can to ensure that you complete your required conditions both successfully and timely. 

Complying with Your Probationary Conditions, with Assistance from Your Officer, Will Help You Succeed.

  • Probation Services does not work for the prosecutor or defense; we work for the 16th Judicial Circuit.
  • A Probation Officer (PO) will be assigned to you. Your PO will instruct you on the conditions of your probation and will inform the Judge if you are (or are not) in compliance.
  • You can find your conditions listed on your Court Minutes, Order of Probation, Pretrial Intervention Agreement or your Back-on-Track Agreement. Further important information will be given to you once YOU reach out and contact your assigned officer.
  • You and your PO work as a team so you can successfully complete all your required conditions. Make sure your PO always has your current phone number, email and physical/mailing address.

How to Be Successful with Probation Services

  • Be honest with your PO and communicate. We are here to help. Remaining in contact with us increases your chances of compliance.
  • Reach out to your attorney, whenever possible, if any sentencing questions or roadblocks to completing your conditions arise.

If you violate your conditions, either an arrest warrant or a program rejection memo could be issued.

Court Ordered Requirements

Once you contact your assigned PO, they will review your specific, court-ordered conditions with you.               

All Defendants

  • Notify Probation if you are leaving the country.
  • Refrain from Criminal Activity/New Arrests
  • Monthly on-line reporting. Be sure to keep your PO updated with your current cell phone & email.

Some Defendants

  • Random Urinalysis (Alcohol and/or Illicit Substances)
  • No Contact or No Harmful Contact Order
  • Community Service Hours
  • Treatment/Rehab or Mental Health Counseling
  • Other Conditions as Ordered by Judge, such as No Fishing in Monroe County Waters or attend Probation Court

Successful Probation Completion Vs. Non-Compliance

You will be expected to comply with the conditions of your supervision from the date of your sentence until the expiration of your probation. Though many succeed, there are times when non-compliance issues do occur, such as:

  • Two or more Missed Monthly Check-ins
  • Positive Alcohol and/or Drug Test
  • Failing to Appear for Test; or Insufficient or
  • Invalid Urine Sample
  • Violation of No Contact or No Harmful Contact Order
  • Failure to Complete Required Conditions or Pay Fines/Fees Owed
  • New Arrest

Judges will be notified of any non-compliance issues and may choose to have you taken into custody. A warrant will then be issued for your arrest. Once the warrant is served, you will be brought back before the Court to answer the allegations against you. Please comply with each of your court-ordered Probation Conditions. Everyone wins when the rules are followed.

Random Urinalysis Testing

Random urinalysis for the presence of illicit drugs, alcohol, or both illicit drugs and alcohol, may be required as a condition of your probation.

  • If required to undergo random urinalysis testing, you will receive both a text notification and email from Probation Services the day before you are to appear for your test.
  • Testing takes place in Key West, Marathon, and Plantation Key (see next column for specific testing times and locations) or elsewhere if you live outside Monroe County (see below).
  • In Monroe County, each test costs $10, payable by money order/cashier’s check ONLY to BOCC; neither cash nor personal checks will be accepted.
  • If you take any prescribed medications, ask your pharmacy to provide a list of current medications OR take clear photos of your medication(s) showing type of medication, quantity, date and the number of refills. This information must be provided to your probation officer and to Lab staff at your first test.
  • Please show up at your testing site fifteen (15) minutes early since there will be paperwork to fill out and sign before your first test.
  • If you are traveling outside Monroe County, follow the procedure below for testing outside the Florida Keys.

If you reside OUTSIDE Monroe County (Florida Keys)

  • If required to undergo random urinalysis testing, you will receive a text notification from Probation Services the day before you are to appear for your test. Since you are testing outside of Monroe County, you can test on either the day you receive the text or on the day you are assigned.
  • When you receive the text notifying you of your random urinalysis test date, please click on the CMG (Coe Management Group) link included in the text (https://form.jotform.com/Coe_Management_Group/PRETRIALandPROBATION-FORM) to pay with a credit/debit card online (if unable to access CMG online, you can call them at 336-768-8104 and pay by telephone).
  • You must prepay through CMG before showing up for your random urinalysis test (Note: If you get notified on a Sunday for a Monday test, you will not be able to call CMG until Monday morning, since their hours are M-F 8am to 6pm).
  • Within an hour of prepaying for your test, you will receive both a Confirmation ID and a REGISTRATION NUMBER from CMG (If you paid but have not received a registration number within the hour, contact CMG at 336-768-8104).
  • You will need to pay and register through CMG each time you receive notification of an upcoming random urinalysis test and prepay before arriving at your testing site.
  • CMG, after processing your payment and inputting you into their system, will assign you a registration number you will need to present to LabCorp, the testing facility CMG uses for random urinalysis testing.
  • Go to www.labcorp.com before your assigned test date and enter your zip code to find the testing facility closest to you. Please make sure the lab you choose offers drug/alcohol testing and be sure to check the lab’s hours for testing before you go, since their testing hours may not be the same as the lab’s regular business hours.
  • Also, you need to bring a picture ID with you each time you go to LabCorp or you will not be able to test.
  • If you take any prescribed medications, please ask your pharmacist for a list of your current or active medications. You must then provide this list to your probation officer by either email. Your notification text/email will contain the link to register and pay $40 in advance. Or call CMG at (336) 768-8104 to pay. Once you receive a registration number, please keep it, since you must take it with you to the LabCorp facility where you’ll be testing.

You must follow the registration procedure prior to going LABCORP and bring a photo ID or you will not be permitted to test.
